How does the request process work?

You submit basic information about a VA disability claim or decision. VA Disability Help is a marketing service that sends the request to Milberg, PLLC for review. The firm decides whether it can help. Submitting a request does not create an attorney-client relationship.

We collect only what is needed to understand the situation and contact you. We never ask for a Social Security number, VA file number, DD-214, bank details, or medical records on this form.

What are the main deadlines for VA decision review?

For decisions dated on or after February 19, 2019, the Appeals Modernization Act offers three lanes: Higher-Level Review, Supplemental Claim, and Board of Veterans' Appeals. You generally have one year from the decision letter to file (38 C.F.R. § 3.2500(h)). Staying within one year of each decision keeps the original effective date.

After a Board denial, you generally have 120 days to appeal to the U.S. Court of Appeals for Veterans Claims (38 U.S.C. § 7266). Board average pending ages are about 7 months for Direct Review, 8 months for Evidence Submission, and 2.4 years for Hearing (BVA, 2026). These are averages, not promises.

Frequently asked questions

Who reviews the requests from this website?
Requests are reviewed by Milberg, PLLC (formerly Milberg Coleman Bryson Phillips Grossman, PLLC). VA Disability Help is an independent marketing service and is not a law firm. Milberg, PLLC does not own or operate this website.
What information do you collect?
We collect your name, phone, optional email, state, ZIP if provided, role, whether you have a VA decision, decision date if known, issue type, representation status, and a short message. We also record consent. We do not collect Social Security numbers or medical records on this form. Only VA Disability Help and Milberg, PLLC see the request for review purposes.
Who sees my information?
Your request is seen by VA Disability Help for processing and by Milberg, PLLC for legal review. We do not sell sensitive health or service information. Data is transmitted over TLS.
Can I opt out of calls and texts?
Yes. Reply STOP to any text to opt out. Reply HELP for help. Message and data rates may apply. Consent is not required to use the service.
Which states can you accept requests from?
Due to state rules, we are not able to accept requests from some states; see /states. The server checks your state and ZIP. Blocked states are not stored or forwarded.
Do I need a Social Security number to request a review?
No. We never ask for a Social Security number, VA file number, or DD-214 on this form.
How do fees work for VA claims?
Accredited attorneys and agents may not charge for work before the VA's initial decision (38 U.S.C. § 5904(c)(1)). After that, fees are usually contingent on past-due benefits. 20% or less is presumed reasonable; over 33⅓% is presumed unreasonable (38 C.F.R. § 14.636). The VA can pay the attorney directly from back pay at 20% or less. No back pay usually means no fee. Veterans Service Organizations are always free.
What is the one-year deadline?
For most decisions on or after February 19, 2019, you generally have one year to file a Higher-Level Review, Supplemental Claim, or Board appeal. Filing within one year of each decision preserves the original effective date (38 C.F.R. § 3.2500(h)).
What happens after a Board denial?
You generally have 120 days to file a notice of appeal with the U.S. Court of Appeals for Veterans Claims (38 U.S.C. § 7266).
Can I get free help?
Yes. Free help with VA claims is available from accredited Veterans Service Organizations. You can find an accredited representative at the VA site.
What are the 2026 compensation rates?
For a veteran alone (effective December 1, 2025): 10% $180.42; 20% $356.66; 30% $552.47; 40% $795.84; 50% $1,132.90; 60% $1,435.02; 70% $1,808.45; 80% $2,102.15; 90% $2,362.30; 100% $3,938.58. Rates with a spouse are higher starting at 30%. Source: VA.gov rates table. Next adjustment is December 1, 2026.
What is TDIU?
Total Disability based on Individual Unemployability pays at the 100% rate when service-connected conditions prevent substantially gainful work. Schedular thresholds are one condition at 60% or more, or combined 70% with one at 40% or more (38 C.F.R. § 4.16).
How do combined ratings work?
The VA uses whole-person math, not simple addition (38 C.F.R. § 4.25). For example, 50% plus 30% becomes 65%, which rounds to 70%. A bilateral factor can apply (38 C.F.R. § 4.26).
What is the PACT Act?
The PACT Act of August 10, 2022 added presumptions for burn pits, airborne hazards, and additional Agent Orange locations. Gulf War undiagnosed illness must appear to a 10% degree by December 31, 2026 (38 C.F.R. § 3.317).
Does submitting a form create a lawyer-client relationship?
No. An attorney-client relationship forms only after a written agreement with Milberg, PLLC. This website is attorney advertising.
How do I confirm a representative is accredited?
Any attorney who represents you before the VA must be accredited by the VA (38 C.F.R. § 14.629). You can confirm accreditation using the VA's accreditation search at va.gov.
